McNabola Law Group obtained a multi-million dollar settlement for the family of a 14-year-old boy who was struck by a semi-truck as he was crossing the street in Cook County. The insurance company paid its policy limits.
On March 5, 2019, the boy was walking home from school on the north side of 51st Street heading west wearing headphones, crossing over Western Avenue in Chicago. While the boy was crossing, a semi-truck pulling a trailer made a wide right turn from 51st Street onto northbound Western Avenue. The rear of the trailer collided with the boy who was then run over by the back tires of the trailer, killing him instantly. At the time of the impact, the pedestrian entered the street even though the signal warned him not to walk.
“Some truck drivers drive too fast for conditions and often fail to anticipate potential dangers on the road. This is especially dangerous in urban Chicago where pedestrians are frequently present. The driver in this case drove too fast and made a wide right turn, which are violative of basic trucking safety regulations taught in entry level driving courses,” said McNabola Law Group parter Mark McNabola.
The settlement proceeds were obtained by McNabola, firm partner Don McGarrah, and associate David McCracken in April 2021 and will be divided amongst the boy’s surviving parents and three siblings to attempt to compensate them for this tragic loss.
