McNabola Law Group filed a lawsuit against a driver who seriously wounded a bicyclist crossing the street in a Lake County crosswalk in May.

The 41-year-old cyclist, a father and businessman, suffered major internal injuries and 14 broken ribs. He required extensive surgery.

“This was entirely avoidable,” McNabola Law Group partner Mark McNabola said. “Drivers should know yellow signs at crosswalks are the equivalent of a stop sign. People depend on drivers to know the rules of the road and follow the law.”

The cyclist was riding his bike along the Skokie Valley Bike Path in Lake Forest, Ill., on May 9, 2020, when he crossed Westleigh Road within a crosswalk for bicycles marked on the pavement with white paint. A bright yellow sign alerted drivers to the presence of both pedestrians and bicycles.

A woman driving west on Westleigh Road near its intersection with Skokie Highway, without braking, slammed into the cyclist, who is an experienced rider.

A caller described the man as “unconscious and breathing” after the incident, The Cardinal reported. He was taken to the Level I Trauma Center at Advocate Condell Medical Center in Libertyville, Ill.

“It’s clear to any driver on this stretch of road that they’re going to encounter pedestrians and bicyclists,” McNabola said. “This driver had an obligation to pay attention and stop for the bicyclist in the crosswalk.”

McNabola and McNabola Law Group associate David McCracken filed a negligence lawsuit in the Circuit Court of Lake County on May 22, 2020. The suit alleges the driver failed to keep a proper lookout, failed to stop and was driving faster than was appropriate for the road conditions.

The case is pending.
