CHICAGO — A state appeals panel today upheld a $25 million settlement originally obtained by Mark McNabola of McNabola Law Group.
Scot Vandenberg suffered catastrophic injuries when he fell from a negligently designed and manufactured boat. In his early 40s, Scot became a quadriplegic and has, since that time, required round the clock care. This decision and this settlement will help Scot and Patricia and their children move on with their lives.
“We are pleased with the decision and very happy for the Vandenberg family,” McNabola says. “We worked very hard on their behalf for over five years preparing and trying the case before a jury. This decision is the right one, and brings long awaited closure to a difficult and stressful period for the Vandenberg family.”
The settlement was originally reached in June 2015, but the defendant alleged misconduct in the case in an effort to get it thrown out. The settlement was upheld by the Hon. Judge James O’Hara of the Circuit Court of Cook County in December 2016, and affirmed this week by the 1st District Appellate Court.
The Appellate Court decision once again validates that McNabola did exactly what any competent trial lawyer was required to do under the circumstances. He zealously represented the Vandenbergs at all times.
